Returns and Refunds Policy

AND THE NEW ATHLETIC PTY LTD (trading as "And The New") is committed to providing quality products to our customers. This Returns and Refunds Policy outlines your rights to return goods purchased through our e-commerce website, the applicable conditions for refunds, and your entitlements under Australian Consumer Law (ACL).
2. Australian Consumer Law Guarantees
2.1 Consumer Rights: All goods sold by AND THE NEW ATHLETIC PTY LTD come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
3. Eligibility for Returns
3.1 Return Period: You are entitled to return an item within fourteen (14) days from the date of receipt, subject to the conditions set out below.
3.2 Condition of Goods: To be eligible for a return, the item must be in its original condition, unused, unwashed, with all original tags and packaging intact. Items that are returned in a used, damaged, or otherwise non-resalable condition may be rejected.
4. Major vs Minor Failures
4.1 Major Failure: If a product is determined to have a major failure (e.g., significantly different from its description, unsafe, or not fit for its intended purpose), you have the right to choose between a replacement or a refund.
4.2 Minor Failure: For products with minor issues, we may choose to provide a repair within a reasonable time frame. If a repair is not possible, we will offer a replacement or refund.
5. Items Excluded from Returns
5.1 Non-Returnable Items: The following items are not eligible for return:
- Custom-made or personalised goods.
- Goods marked as "Final Sale" or "Non-Returnable."
- Goods that have been used, altered, or washed.
6. Return Procedure

6.2 Shipping of Returns: For returns due to change of mind, you are responsible for return shipping costs. We strongly recommend using a trackable shipping service or purchasing shipping insurance, as we cannot guarantee receipt of your returned item without proper tracking information.
For returns related to faulty or incorrect goods, AND THE NEW ATHLETIC PTY LTD will cover reasonable shipping costs in compliance with ACL.
7. Refunds
7.1 Inspection of Returned Goods: Upon receipt of the returned goods, we will conduct an inspection to determine their eligibility for a refund. We will notify you via email upon completion of the inspection.
7.2 Refund Eligibility and Method: If your return is approved, the refund will be processed to the original method of payment within a reasonable period, generally within fourteen (14) business days from the date of approval. Please note that processing times may vary depending on your financial institution.
7.3 Deductions: Original shipping costs are non-refundable for change-of-mind returns. Additionally, we reserve the right to deduct any fees incurred as a result of the return.
8. Defective or Damaged Goods
8.1 Reporting Defective Goods: If you receive a defective or damaged product, please contact us immediately at admin@andthenewathletic.com with detailed information, including photographs. We will arrange for the item to be replaced or refunded, as deemed appropriate by us.
